A Supreme Rebuff?

On the eve of President Obama’s State of the Union address,  it is not clear if Chief Justice John Roberts will attend.  Associate Justice Samuel Alito plans to skip the event.

In his last address, President Obama chastised the Supreme Court justices for their Citizens United decision, which allowed more unregulated money into political campaigns.

Court to Consider Medicaid Reductions

In a case that all states with budget deficits will be watching, the U.S. Supreme Court has agreed to consider whether state officials in California can cut medicaid payments in order to balance the state’s budget deficit and still be in compliance with federal Medicaid law. The case is Maxwell-Jolly v. Independent Living Center, 09-958.  It will be considered later this year.

No Review for D.C. Same-Sex Marriage Law

The U.S. Supreme Court has declined to review a legal challenge to a recently enacted same-sex marriage law in the District of Columbia.  The court issued the denial without an explanation.

A First For Kagan

Associate Justice Elena Kagan wrote her first opinion yesterday and ruled in a favor of a credit card company involved in a bankruptcy dispute.  In the 8-1 decision (Justice Scalia dissenting), Kagan held that monthly car payments could not be deducted because the vehicle at issue had already been paid in full.
